Cross-Border Pension Schemes
A commencement order permitting tax relief for certain cross-border pension schemes was signed on 21 September 2005.
FA05 s. 21 provides for a statutory scheme of relief for contributions paid by a migrant worker who comes to the State and who wishes to continue to contribute to a pre-existing “overseas pension plan” concluded with a pension provider in another EU Member State. To qualify for the relief, certain conditions and information requirements must be met as set out in the section.
The commencement order, S.I. 570 of 2005, specifies that the provision, now TCA97 s. 790B, has effect from 23 September 2005. The full text is carried at Section 2.07.
