Revenue guidelines on the exchange of information on tax rulings

Revenue has published guidelines on Arrangements for Implementing EU and OECD Exchange of Information Requirements in respect of tax rulings. The arrangements allow for the spontaneous exchange of information in respect of cross-border rulings where such rulings could affect the tax base of another Member State.

The guidelines outline the information to be exchanged and how Revenue will implement these requirements. From 1 April 2016, where a taxpayer seeks an opinion from Revenue, Revenue will notify the taxpayer if it falls within the scope of the EU or OECD frameworks. The EU initiative becomes effective from 1 January 2017; while the OECD model has been effective since 1 April 2016.

It should be noted that the initiatives will apply to opinions issued by Revenue to entities in respect of taxes other than VAT, Customs Duties and Excise Duties. Revenue eBrief No. 65/16 on here provides more details.
